Terms of Service

These Terms govern your use of presencaagency.com and the services provided by Presença Agency ("we", "us"). By using our website or engaging us, you agree to these Terms.

1. Services

We provide website design and development, Google review automation, local SEO, and ongoing digital presence management. Specific scope, deliverables, and timelines for each engagement are set out in a separate proposal or order confirmation, which together with these Terms forms our agreement.

2. Quotes and pricing

Prices displayed on our website are starting prices in GBP and exclusive of VAT unless stated. Formal quotes are valid for 30 days. Recurring services (Review Autopilot, Growth, Pro) are billed monthly in advance.

3. Payment

• One-off website builds: 50% deposit to start, 50% on launch.
• Monthly plans: billed in advance; first month payable before activation.
• Late payments may incur interest at the statutory rate (Late Payment of Commercial Debts Act 1998).

4. Client responsibilities

You agree to provide content, brand assets, and feedback within the timescales agreed in your proposal. Delays caused by missing input may extend the project timeline. You confirm you own or have permission to use any content you supply.

5. Intellectual property

On full payment, you own the final website design, content, and any custom code we produce for you. We retain ownership of underlying tools, frameworks, and templates we reuse across clients, and may showcase the finished project in our portfolio unless you ask us not to in writing.

6. Cancellation

Monthly plans can be cancelled with 30 days' written notice. One-off builds cancelled after work has started are billed pro-rata for time already spent. Deposits are non-refundable once production has begun.

7. Warranties and limitation of liability

We deliver services with reasonable skill and care. We don't guarantee specific search rankings, traffic, or business outcomes, as these depend on factors outside our control. To the maximum extent permitted by law, our total liability for any claim is limited to the fees paid by you in the 6 months preceding the claim. Nothing in these Terms limits liability for death, personal injury, or fraud.

8. Confidentiality

Both parties agree to keep confidential information shared during the engagement private and to use it only for the purpose of delivering the services.

9. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
